Requirements for tourist homes in Andalusia



The decree that regulates tourist housing prohibits the use of padlocks to access keys on urban furniture and obliges the landlord to inform the rules of coexistence in the neighborhood communities.


Tourism is one of the great economic drivers of Andalusia, but also a headache for city councils where the expansion and growth of this phenomenon is creating problems of coexistence, either because of the return that this activity has in the cities - for which There are sectors that advocate the implementation of the tourist tax - or the colonization of tourist apartments in the old towns of the cities.


Regarding the latter, the Andalusian Government approved on January 29 the decree that regulates apartments for tourist use, a new regulation that town councils now have to apply and which includes a long catalog of requirements to be able to carry out their activity.


Among these mandatory characteristics, the apartment in question must have a minimum surface area of ​​14 square meters per square and can never be less than 25 square meters in total. The Board's decree prohibits boxes for keys and padlocks from being placed on street furniture.


In its decree, the Ministry of Tourism, Culture and Sports details those minimum conditions of habitability and comfort that all homes dedicated to this activity in Andalusia must meet. Furthermore, to operate a tourist apartment, the home must be registered in the registry of the Ministry of Tourism, through a sworn declaration that must comply, among other issues, with municipal regulations.


If you are the owner of a tourist home or, as a traveler, you want to know what requirements the home in which you are going to stay must meet, these are some of the characteristics that it must meet:

Comply with municipal urban planning regulations to be able to provide the tourist accommodation service. Registration will be immediately communicated to the town councils.


  • Have a minimum constructed area for main residential use of 25 m². A minimum of 14 m² per space is required.


  • Provide cooling and heating, centralized or non-centralized in the rooms and living rooms.


  • Be sufficiently furnished and equipped with the necessary appliances and fixtures for immediate use and according to the number of seats available, have a television and channel information, among others.


  • First aid kit.


  • Have tourist information, in physical or electronic format, about the area, leisure areas, restaurants and cafes, shops and food stores, parking closest to the home, existing medical services in the area, means of urban transport and a map of the town.


  • Information and operating instructions for appliances or other devices that require it for their correct use.


What must necessarily be in a bedroom or living room of a tourist apartment?


The bedrooms and living rooms are the spaces in which, as a general rule, we spend the most time during a stay in a tourist apartment. The decree of the Junta de Andalucía regulates what minimum a home of these characteristics must have.

The bedrooms and living rooms will have direct ventilation to the outside or to ventilated patios and some window darkening system.


  • The beds must measure at least 80 x 190 centimeters if it is a single and 135 x 190 centimeters if it is a double. 


  • Have a closet or space for clothing for every four people, with an appropriate number of hangers.


  • Light point next to the bed.  


  • Mattresses must have a minimum thickness of 18 centimeters and must be in good condition and present a homogeneous level of resistance across the entire surface.


  • Well-preserved bedding, lingerie, blankets or duvets and pillows depending on the occupancy of the home and a replacement set of bedding.


¿In the kitchen?


The kitchens of the tourist apartments, at a minimum, must have:


  • Have direct or forced ventilation for air renewal.


  • The kitchen must be equipped with a minimum of two burners, an oven or microwave and a refrigerator.


  • Utensils appropriate to the accommodation capacity (at least crockery, cutlery, glassware, pans, pots, serving cutlery, corkscrew, opener, scissors, can opener and drainer).


  • Small appliances (at least blender, toaster or grill, juicer and coffee maker).


  • Storage furniture.


  • Utensils and kit of cleaning products with a minimum content of scouring pad, cloth, cloth, cleaning gel and garbage bags


  • Clothesline, iron and ironing board.


  • Selective waste separation.


  • Smoke detector.


  • A fire extinguisher.


The bathroom, the place that measures the quality of the apartment


The bathroom of any home that is operated for tourist use in Andalusia must have at least:


  • Direct or forced ventilation for air renewal.


  • Two bathrooms if the number of places is greater than five and three bathrooms if the number of places is greater than eight.  


  • At least a toilet, sink, bathtub or shower tray. .


  • Non-slip floors in showers and bathtubs.


  • Hand soap, gel, shampoo, one hand towel and one bath towel per person, washable bathroom mat, toilet paper roll and one additional one.


  • Mirror with power plug nearby.


  • Appropriate light in the bathroom, towel hangers, toilet brush, shelf, dryer and hygienic bucket.


What are the obligations of the owners of the exploitation of housing for tourist use?


  • Telephone support 24 hours a day to immediately respond to and resolve any queries or incidents related to the home.   


  • Clean the home upon entry and exit of new users.   


  • Have official Complaints and Claims Sheets from the Junta de Andalucía available to users and a poster announcing them in a visible place inside the home.


  • Provide proof of payment for the services and advance payments made, if applicable, with the following content, without prejudice to compliance with current provisions for tax purposes: 


  • Identification of the person responsible for the exploitation of the home


  • Identification of the home and its registration code in the Andalusian Tourism Registry


  • Identification of the user


  • Number of people accommodated


  • Entry and exit date


  • Price of the contracted service and payment date


  • The owners of the operation who, in accordance with tax regulations, have the obligation to issue an invoice, must comply with the requirements that apply to them.


  • Inform users if they are members of the Consumer Arbitration System.
